1 ἐὰν δὲ εὑρεθῇ τραυματίας ἐν τῇ γῇ ᾗ κύριος ὁ θεός σου δίδωσίν σοι κληρονομῆσαι πεπτωκὼς ἐν τῷ πεδίῳ καὶ οὐκ οἴδασιν τὸν πατάξαντα 2 ἐξελεύσεται ἡ γερουσία σου καὶ οἱ κριταί σου καὶ ἐκμετρήσουσιν ἐπὶ τὰς πόλεις τὰς κύκλῳ τοῦ τραυματίου 3 καὶ ἔσται ἡ πόλις ἡ ἐγγίζουσα τῷ τραυματίᾳ καὶ λήμψεται ἡ γερουσία τῆς πόλεως ἐκείνης δάμαλιν ἐκ βοῶν ἥτις οὐκ εἴργασται καὶ ἥτις οὐχ εἵλκυσεν ζυγόν 4 καὶ καταβιβάσουσιν ἡ γερουσία τῆς πόλεως ἐκείνης τὴν δάμαλιν εἰς φάραγγα τραχεῖαν ἥτις οὐκ εἴργασται οὐδὲ σπείρεται καὶ νευροκοπήσουσιν τὴν δάμαλιν ἐν τῇ φάραγγι 5 καὶ προσελεύσονται οἱ ἱερεῖς οἱ Λευῖται ὅτι αὐτοὺς ἐπέλεξεν κύριος ὁ θεός σου παρεστηκέναι αὐτῷ καὶ εὐλογεῖν ἐπὶ τῷ ὀνόματι αὐτοῦ καὶ ἐπὶ τῷ στόματι αὐτῶν ἔσται πᾶσα ἀντιλογία καὶ πᾶσα ἁφή 6 καὶ πᾶσα ἡ γερουσία τῆς πόλεως ἐκείνης οἱ ἐγγίζοντες τῷ τραυματίᾳ νίψονται τὰς χεῖρας ἐπὶ τὴν κεφαλὴν τῆς δαμάλεως τῆς νενευροκοπημένης ἐν τῇ φάραγγι 7 καὶ ἀποκριθέντες ἐροῦσιν αἱ χεῖρες ἡμῶν οὐκ ἐξέχεαν τὸ αἷμα τοῦτο καὶ οἱ ὀφθαλμοὶ ἡμῶν οὐχ ἑωράκασιν 8 ἵλεως γενοῦ τῷ λαῷ σου Ισραηλ οὓς ἐλυτρώσω κύριε ἐκ γῆς Αἰγύπτου ἵνα μὴ γένηται αἷμα ἀναίτιον ἐν τῷ λαῷ σου Ισραηλ καὶ ἐξιλασθήσεται αὐτοῖς τὸ αἷμα 9 σὺ δὲ ἐξαρεῖς τὸ αἷμα τὸ ἀναίτιον ἐξ ὑμῶν αὐτῶν ἐὰν ποιήσῃς τὸ καλὸν καὶ τὸ ἀρεστὸν ἔναντι κυρίου τοῦ θεοῦ σου 1 When, in this land of thine, a dead man’s body is found and there is no knowing who slew him, 2 elders and judges must betake themselves to the spot where he lies, and find by measurement which of the neighbouring cities is nearest at hand. 3 It is for the elders of the nearest city to do what must be done. They will choose out from the herd a heifer that has never borne yoke or ploughed furrow, 4 and in some wild and rugged glen, that was never ploughed or sown, this heifer must have its neck broken. 5 Priests must be there, of Levi’s race; these are the men whom the Lord thy God has chosen to minister to him, and give their blessing in his name, and also to decide between right and wrong, clean and unclean. 6 And the elders of this neighbouring city, close to the dead man,[1] will wash their hands over the heifer that lies slain in the glen, 7 protesting, Not ours the hand that shed this blood; our eyes never witnessed the deed; 8 be merciful, Lord, to Israel, the people thou hast claimed for thyself; do not charge Israel, thy own people, with guilt because it is stained with an innocent man’s blood. So shall they be quit of all blame for the murder. 9 Do my bidding, and the guilt of blood wrongfully shed shall never rest upon thee. 1 Quando inventum fuerit in terra, quam Dominus Deus tuus daturus est tibi, hominis cadaver occisi, et ignorabitur cædis reus, 2 egredientur majores natu, et judices tui, et metientur a loco cadaveris singularum per circuitum spatia civitatum: 3 et quam viciniorem ceteris esse perspexerint, seniores civitatis illius tollent vitulam de armento, quæ non traxit jugum, nec terram scidit vomere, 4 et ducent eam ad vallem asperam atque saxosam, quæ numquam arata est, nec sementem recepit: et cædent in ea cervices vitulæ: 5 accedentque sacerdotes filii Levi, quos elegerit Dominus Deus tuus ut ministrent ei, et benedicant in nomine ejus, et ad verbum eorum omne negotium, et quidquid mundum, vel immundum est, judicetur. 6 Et venient majores natu civitatis illius ad interfectum, lavabuntque manus suas super vitulam, quæ in valle percussa est, 7 et dicent: Manus nostræ non effuderunt sanguinem hunc, nec oculi viderunt: 8 propitius esto populo tuo Israël, quem redemisti, Domine, et ne reputes sanguinem innocentem in medio populi tui Israël. Et auferetur ab eis reatus sanguinis: 9 tu autem alienus eris ab innocentis cruore, qui fusus est, cum feceris quod præcepit Dominus.
10 ἐὰν δὲ ἐξελθὼν εἰς πόλεμον ἐπὶ τοὺς ἐχθρούς σου καὶ παραδῷ σοι κύριος ὁ θεός σου εἰς τὰς χεῖράς σου καὶ προνομεύσεις τὴν προνομὴν αὐτῶν 11 καὶ ἴδῃς ἐν τῇ προνομῇ γυναῖκα καλὴν τῷ εἴδει καὶ ἐνθυμηθῇς αὐτῆς καὶ λάβῃς αὐτὴν σαυτῷ γυναῖκα 12 καὶ εἰσάξεις αὐτὴν ἔνδον εἰς τὴν οἰκίαν σου καὶ ξυρήσεις τὴν κεφαλὴν αὐτῆς καὶ περιονυχιεῖς αὐτὴν 13 καὶ περιελεῖς τὰ ἱμάτια τῆς αἰχμαλωσίας αὐτῆς ἀ{P'} αὐτῆς καὶ καθίεται ἐν τῇ οἰκίᾳ σου καὶ κλαύσεται τὸν πατέρα καὶ τὴν μητέρα μηνὸς ἡμέρας καὶ μετὰ ταῦτα εἰσελεύσῃ πρὸς αὐτὴν καὶ συνοικισθήσῃ αὐτῇ καὶ ἔσται σου γυνή 14 καὶ ἔσται ἐὰν μὴ θέλῃς αὐτήν ἐξαποστελεῖς αὐτὴν ἐλευθέραν καὶ πράσει οὐ πραθήσεται ἀργυρίου οὐκ ἀθετήσεις αὐτήν διότι ἐταπείνωσας αὐτήν 10 When the Lord gives thee victory over thy enemies in battle, and thou bringest back prisoners, 11 dost thou see among them a woman so fair that she wins thy heart, and thou wouldst marry her? 12 Take her, then, into thy house; and there she must shave her head and pare her nails close, 13 and lay aside the garb of a captive, that she wore till now. Let her have a month, dwelling in thy house, to bewail the loss of her father and mother; then thou mayest take her to thy bed and make her thy wife. 14 But if, afterwards, she does not answer thy mood, she must go free; thou hast no power to sell her or exercise lordship over her, when once thou hast robbed her of maidenhood. 10 Si egressus fueris ad pugnam contra inimicos tuos, et tradiderit eos Dominus Deus tuus in manu tua, captivosque duxeris, 11 et videris in numero captivorum mulierem pulchram, et adamaveris eam, voluerisque habere uxorem, 12 introduces eam in domum tuam: quæ radet cæsariem, et circumcidet ungues, 13 et deponet vestem, in qua capta est: sedensque in domo tua, flebit patrem et matrem suam uno mense: et postea intrabis ad eam, dormiesque cum illa, et erit uxor tua. 14 Si autem postea non sederit animo tuo, dimittes eam liberam, nec vendere poteris pecunia, nec opprimere per potentiam: quia humiliasti eam.
15 ἐὰν δὲ γένωνται ἀνθρώπῳ δύο γυναῖκες μία αὐτῶν ἠγαπημένη καὶ μία αὐτῶν μισουμένη καὶ τέκωσιν αὐτῷ ἡ ἠγαπημένη καὶ ἡ μισουμένη καὶ γένηται υἱὸς πρωτότοκος τῆς μισουμένης 16 καὶ ἔσται ᾗ ἂν ἡμέρᾳ κατακληροδοτῇ τοῖς υἱοῖς αὐτοῦ τὰ ὑπάρχοντα αὐτοῦ οὐ δυνήσεται πρωτοτοκεῦσαι τῷ υἱῷ τῆς ἠγαπημένης ὑπεριδὼν τὸν υἱὸν τῆς μισουμένης τὸν πρωτότοκον 17 ἀλλὰ τὸν πρωτότοκον υἱὸν τῆς μισουμένης ἐπιγνώσεται δοῦναι αὐτῷ διπλᾶ ἀπὸ πάντων ὧν ἂν εὑρεθῇ αὐτῷ ὅτι οὗτός ἐστιν ἀρχὴ τέκνων αὐτοῦ καὶ τούτῳ καθήκει τὰ πρωτοτόκια 15 If a man twice married loves one wife and is weary of the other, and has children by both, but his first-born by the wife he spurns, 16 how shall he divide up his possessions between them? He shall have no power to make the son of the loved wife his heir, in preference to that other. 17 Recognize the first-born he must, though of the mother he be weary; a double share of all his goods belongs to the son that was engendered first; the birthright is his. 15 Si habuerit homo uxores duas, unam dilectam, et alteram odiosam, genuerintque ex eo liberos, et fuerit filius odiosæ primogenitus, 16 volueritque substantiam inter filios suos dividere, non poterit filium dilectæ facere primogenitum, et præferre filio odiosæ: 17 sed filium odiosæ agnoscet primogenitum, dabitque ei de his quæ habuerit cuncta duplicia: iste est enim principium liberorum ejus, et huic debentur primogenita.
18 ἐὰν δέ τινι ᾖ υἱὸς ἀπειθὴς καὶ ἐρεθιστὴς οὐχ ὑπακούων φωνὴν πατρὸς καὶ φωνὴν μητρὸς καὶ παιδεύσωσιν αὐτὸν καὶ μὴ εἰσακούῃ αὐτῶν 19 καὶ συλλαβόντες αὐτὸν ὁ πατὴρ αὐτοῦ καὶ ἡ μήτηρ αὐτοῦ καὶ ἐξάξουσιν αὐτὸν ἐπὶ τὴν γερουσίαν τῆς πόλεως αὐτοῦ καὶ ἐπὶ τὴν πύλην τοῦ τόπου αὐτοῦ 20 καὶ ἐροῦσιν τοῖς ἀνδράσιν τῆς πόλεως αὐτῶν ὁ υἱὸς ἡμῶν οὗτος ἀπειθεῖ καὶ ἐρεθίζει οὐχ ὑπακούει τῆς φωνῆς ἡμῶν συμβολοκοπῶν οἰνοφλυγεῖ 21 καὶ λιθοβολήσουσιν αὐτὸν οἱ ἄνδρες τῆς πόλεως αὐτοῦ ἐν λίθοις καὶ ἀποθανεῖται καὶ ἐξαρεῖς τὸν πονηρὸν ἐξ ὑμῶν αὐτῶν καὶ οἱ ἐπίλοιποι ἀκούσαντες φοβηθήσονται 18 Is there a son so rebellious and unmanageable that he defies his parents’ bidding, and will not brook restraint? 19 Such a son they must bring by force to the city gate, where the elders are assembled, 20 and make complaint to them, This son of ours is rebellious and unmanageable; he pays no heed to our remonstrances, but must ever be carousing, ever at his wantonness and his cups. 21 Thereupon the citizens shall stone him to death, so that you may be rid of this plague, and every Israelite that hears of it may be afraid to do the like. 18 Si genuerit homo filium contumacem et protervum, qui non audiat patris aut matris imperium, et coërcitus obedire contempserit: 19 apprehendent eum, et ducent ad seniores civitatis illius, et ad portam judicii, 20 dicentque ad eos: Filius noster iste protervus et contumax est: monita nostra audire contemnit, comessationibus vacat, et luxuriæ atque conviviis: 21 lapidibus eum obruet populus civitatis, et morietur, ut auferatis malum de medio vestri, et universus Israël audiens pertimescat.
22 ἐὰν δὲ γένηται ἔν τινι ἁμαρτία κρίμα θανάτου καὶ ἀποθάνῃ καὶ κρεμάσητε αὐτὸν ἐπὶ ξύλου 23 οὐκ ἐπικοιμηθήσεται τὸ σῶμα αὐτοῦ ἐπὶ τοῦ ξύλου ἀλλὰ ταφῇ θάψετε αὐτὸν ἐν τῇ ἡμέρᾳ ἐκείνῃ ὅτι κεκατηραμένος ὑπὸ θεοῦ πᾶς κρεμάμενος ἐπὶ ξύλου καὶ οὐ μιανεῖτε τὴν γῆν ἣν κύριος ὁ θεός σου δίδωσίν σοι ἐν κλήρῳ 22 When a man is guilty of a capital crime, and his sentence is to hang on a gallows, 23 his body must not be left to hang there on the gibbet, it must be buried the same day. God’s curse lies on the man who hangs on a gibbet, and the land which the Lord thy God gives thee for thy own must not suffer pollution. 22 Quando peccaverit homo quod morte plectendum est, et adjudicatus morti appensus fuerit in patibulo: 23 non permanebit cadaver ejus in ligno, sed in eadem die sepelietur: quia maledictus a Deo est qui pendet in ligno: et nequaquam contaminabis terram tuam, quam Dominus Deus tuus dederit tibi in possessionem.
